User Terms and Conditions
- When a consumer makes purchases of goods or services through the website, such transactions are considered Distance Contracts and are subject to the laws of the Republic of Latvia that regulate Distance Contracts, including but not limited to the “Consumer Protection Law of the Republic of Latvia” and the “Regulations on Distance Contracts” issued by the Cabinet of Ministers of the Republic of Latvia, etc.
- The prices and specifications of products sold on the website are listed alongside the products. The product price is specified per unit (piece). To make a purchase, add the desired products to your shopping cart. Fill in all mandatory fields and choose the most suitable delivery method. The total cost of the order, including delivery, will be displayed on the “shopping cart summary” screen. Complete the purchase by making the payment. Upon a successful purchase, the buyer will receive an order confirmation at the provided email address.
Conditions for the “2 + 1” Promotion
- The terms of the “buy 2 + 1, get the third as a gift” promotion state that when a customer pays for (buys) two (2) identical products, the third (3rd) product is sent as a gift. These promotion terms are not applicable when purchasing one (1) product from one category and one (1) from another category. The promotion term is considered applicable if the free product is indicated in the seller’s sent purchase confirmation email.
- In case a customer has a unique promotional code providing a percentage or sum discount for products in the www.lyl.eu store, it will not be combined with other promotions, including the “buy 2 + 1, get one free” promotion unless explicitly stated.
- The currency of payment on the website is Euro. Purchases can be paid for by choosing from the following payment methods provided by the makecommerce.lv payment platform, Maksekeskus AS: Add those payment methods which your online store utilizes:
- Latvian internet bank payments: Swedbank, SEB, Citadele, and Luminor.
- Estonian internet bank payments: Swedbank, SEB, Luminor.
- Lithuanian internet bank payments: Swedbank, SEB, and Luminor.
- Finnish internet bank payments: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, Säästopankki.
- Visa/Mastercard card payments. Note: When using the internet bank payment method, confirm the order and click the “Return to the merchant” button.
- Personal data required for making payments will be transferred to a licensed payment institution, Maksekeskus AS.
- The contract becomes effective upon successful payment to the online store’s bank account. If, for any reason, it becomes impossible to fulfill the order, the buyer will be notified, and the paid amount will be refunded as soon as possible but no later than 14 days after receiving the notice.
7. The www.lyl.eu online store services, including but not limited to product (shipment) packaging, delivery, returns, and communication with the buyer (customer) on behalf of SIA “pharm&med”, are provided by the delivery intermediary company SIA “OZERMEDIA”, unified registration number 40103678683. Products are delivered to the following countries: Latvia, Europe, etc. The purchased products are delivered as follows:
- European Union: Mail delivery operated by Latvian Post or Express Delivery (Express Mail Service), depending on the customer’s choice. The delivery time usually takes from 4 to 10 working days at the latest. Trackable shipment. You will receive a tracking code for the shipment so that you can monitor the delivery status of your package.
- EEA Member States: Mail delivery operated by Latvian Post or Express Delivery (Express Mail Service), depending on the customer’s choice. The delivery time usually takes from 4 to 10 working days at the latest. Trackable shipment. You will receive a tracking code for the shipment so that you can monitor the delivery status of your package.
- Worldwide: Mail delivery operated by Latvian Post or Express Delivery (Express Mail Service), depending on the customer’s choice. The delivery time usually takes from 7 to 20 working days at the latest. Trackable shipment. - Latvia: Mail delivery operated by Latvian Post or Omniva parcel locker/courier delivery, depending on the customer’s choice. The delivery time is 2 to 4 working days at the latest. During holidays and increased workload, the delivery time may take up to 7 working days.
- Lithuania, Estonia: Mail delivery operated by Latvian Post, Omniva, Venipak parcel locker/courier, depending on the customer’s chosen delivery method. The delivery time is 2 to 4 working days at the latest. During holidays and increased workload, the delivery time may take up to 7 working days.
- The supplier ensures the dispatch of orders from the warehouse:
- by placing an order on a working day until 17:00 – on the same day;
- by placing an order on Friday after 17:00 or on weekends – on the next working day (Monday);
- by placing an order on the day before a holiday after 17:00 – on the nearest working day.
- Shipments made using AS “Latvijas Pasts”, Omniva, or Venipak delivery intermediaries are assigned a unique SHIPMENT TRACKING CODE, which is sent to the buyer in the purchase confirmation email. It is possible to track such a shipment by clicking on the interactive link in the email.
- If the recipient country of the goods is not an EU Member State, all fees and taxes required to receive the shipment at the delivery destination must be covered by the buyer unless explicitly assumed by the seller.
- Delivery costs are displayed before order confirmation. The purchased goods are delivered to the address specified by the buyer within 1-45 working days. In exceptional cases, we have the right to send the goods within 60 calendar days, informing the customer accordingly.
- The seller is not responsible for the delivery of the shipment if the buyer (customer), when placing the order, has provided an incorrect shipping address, including postal code, city, etc., or if delivery to the specified address cannot be ensured due to reasons beyond the reasonable control of the online store.
Right of Withdrawal
- The buyer has the right to withdraw from the purchase within 14 calendar days from the moment of receiving the goods. The right of withdrawal does not apply if the buyer is a legal entity.
- To exercise the right of withdrawal within 14 days, the goods may only be used for their intended purpose, and the consumer is responsible for maintaining the quality and safety of the goods during the withdrawal period.
- The consumer may exercise the right of withdrawal within 14 days and, without giving any reason, withdraw from the Distance Contract (except for cases when dietary supplements, over-the-counter medicines, and medical products, for which, according to the Cabinet of Ministers Regulations of June 26, 2007, No. 416 “Procedure for the Distribution and Quality Control of Medicinal Products”, specific storage conditions (humidity, light, temperature, etc.) are required.
- To exercise the right of withdrawal, you must submit a withdrawal form, which can be found here: (form), by sending it to the email address email@example.com within 14 days after receiving the goods.
- In the event that a consumer has received a product that corresponds to the description of the goods, as ordered by the consumer, and the goods are not damaged, etc., the consumer covers the costs of returning the goods. In the event that a product that does not conform to the purchase, is damaged, or is incorrect, the seller ensures the return of the goods without additional charges.
- The obligation of the buyer is to return the goods to the seller without delay but no later than 14 days after sending the withdrawal form to the online store. Upon receiving the returned goods, the online store refunds all payments received from the buyer based on the Distance Contract immediately but no later than within 14 days.
- The seller has the right to withhold the payment until the moment the goods are received from the buyer or a return confirmation is received.
- The online store is not responsible for delays in fulfilling obligations, non-fulfillment, or any other type of non-fulfillment due to circumstances and obstacles beyond the reasonable control of the online store.
- The online store reserves the right to refuse to sell products and request the return of products from the buyer if the price indicated in the online store is significantly lower than its market price due to an error.
Consumer Rights for Non-Conforming Goods to the Contract
- The online store is not responsible for defects that have arisen after the delivery of the goods to the buyer. If the purchased goods have defects for which the seller is responsible, the buyer has the right to request the elimination of the defects in the goods or the exchange of the goods for new goods free of charge.
- If it is not possible to repair or replace the goods, the seller refunds all payments received from the buyer based on the Distance Contract. The seller provides a written response to the consumer’s complaint within 15 days.
Processing of Buyer’s Personal Data
- The online store processes only those personal data that the buyer has entered when ordering goods, such as name, surname, email, etc.
- The online store transfers personal data to the transport service provider(s) mentioned in point 4 to ensure the delivery of the goods.
- When shopping on www.lyl.eu, the buyer unequivocally agrees to receive marketing materials (booklets, brochures) and other distribution materials about LYL products, product samples included with the shipment (in the shipment box).
- The buyer also agrees to receive marketing messages, including updates that give LYL the right to contact the buyer by sending information about our services and the latest offers to the buyer’s specified email address or phone number. In this regard, LYL may process the buyer’s email address, which the buyer has provided for marketing communication. The buyer has the option to opt out of marketing communications.
Dispute Resolution Procedure
- In matters not covered by these terms and conditions, the buyer and the seller undertake to comply with the normative acts of the Republic of Latvia.
- The Parties resolve all disputes arising between the Seller and the Buyer through mutual negotiations or in writing. If it is not possible to resolve the dispute through negotiations or in writing, the Parties shall resolve the dispute in the courts of the Republic of Latvia, taking into account the laws of the Republic of Latvia. Disputes between the Buyer (Consumer) and the Seller may be referred to the Consumer Rights Protection Centre or the courts of the Republic of Latvia.
- The buyer also has the right to address European Union dispute resolution authorities.
- The communication panel integrated into the online store (chat site) Tidio maintains the delivery company SIA “OZERMEDIA”.
- This tool is available for the convenience of the customer to quickly and efficiently receive delivery information, general information about products, etc., related to the operation of the online store.
- SIA “OZERMEDIA” is not authorized to provide medical consultations, give health advice, or provide other information directly or indirectly related to health.
- The information provided by SIA “OZERMEDIA” is informative in nature and does not have legal or civil consequences.
